United States District Judge David Hittner today declared a mistrial in the corruption case against Harris County Commissioner Jerry Eversole. The jury had indicated it was hung on Tuesday, but Hittner sent them back for additional deliberations. Today they said again they could not reach a verdict, so the judge ended the trial.
Eversole said he has mixed emotions about the mistrial. "The thing that we've got going for us is we're telling the truth."
Eversole was accused of taking bribes of more than $100,000 in cash, gifts and travel from real estate developer Mike Surface. He also was charged with filing false income tax returns in connection with the benefits.
Federal prosecutors say they plan to try the case again.
Michael Surface, who was accused of bribing Eversole still faces trial.
