Progresso Felon Sentenced to Federal Prison For Possessing a Firearm

McALLEN, Texas – Sergio Hernandez Jr., 21, of Progresso, Texas, has been sentenced to 110 months in federal prison for illegally possessing a revolver, U.S. Attorney Kenneth Magidson announced today. As a previously-convicted felon, Hernandez was banned under federal law from possessing any firearm that had crossed state lines. U.S. District Judge Randy Crane further ordered he serve three years on supervised release following completion of his prison term.

On Jan. 31 of this year, Hernandez pleaded guilty before Judge Crane to being a felon in possession of a firearm. At that time, he admitted that on June 19, 2011, he took a revolver from a Weslaco home and was, at that time, already a convicted felon. He was convicted in 2010 of burglary of a building by the 93rd Judicial District Court in Hidalgo County, Texas.

Hernandez has been in custody since his Aug. 23, 2011, arrest in La Feria, Texas, where he will remain pending transfer to a U.S. Bureau of Prisons facility to be determined in the near future.

The case was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Hidalgo County Sheriff’s Office and was prosecuted by Assistant U.S. Attorney Christopher Sully.
