League City City Council, in a special meeting on Monday, voted 4-1, with Dennis OKeeffe opposed, to approve a negotiated settlement in the matter of Paul Smith, et al. vs. City of League City.
The lawsuit, which had been pending in the 212th Judicial District Court of Galveston County, was in regards to a demolished bridge at the Glen Cove Subdivision.
Under the settlement, the city will pay $225,000 to reimburse attorney’s fees and costs associated with the plaintiff’s case against the city. Additional portions of the settlement state that:
The city acknowledges the rights of owners of the Glen Cove Subdivision
That both parties jointly agree to declare the validity of the city’s title to Marina Way
That the city undertake efforts to secure a written agreement with MB Harbour that a December 2006 deed is no longer in legal effect, and to void the 99-year lease of the property at the bridge site, as well as attempt to reach an agreement for MB Harbour to dedicate the land to the city
