Man Sentenced to 12 Years for Aggravated Sexual Assault of a Child

GALVESTON – Galveston County District Attorney Jack Roady announced today that Ivan Brandy Martinez, 24, was sentenced to 12 years in prison for Aggravated Sexual Assault of a Child and Indecency with a Child by Sexual Contact.

In October 2015, a parent contacted police and reported finding a handwritten letter in the victim’s room saying the victim needed God’s help in telling someone about Martinez. The parent discussed the letter with the victim who said the letter had been written about a year prior. The victim explained that Martinez had sexually assaulted her multiple times when the family lived in another home in League City.

The victim told investigators that the abuse included both touching of her private areas and sexual acts. Through discussions with the victim and the parents, law enforcement determined the assaults occurred between 2008 and 2012 when the victim would have been in elementary school and starting when Martinez was still a juvenile.  Martinez was initially charged as a juvenile and then certified as an adult.

Martinez, who had no prior felony convictions, pled guilty today to both charges. He accepted the State’s punishment offer and was sentenced to 12 years in the Institutional Division of the Texas Department of Criminal Justice. The parents of the victim were in agreement with the resolution of the case. Martinez will have to serve at least one-half of his time before being eligible for parole. If paroled, or upon discharging his sentence, he will be required to register as a Sex Offender until the 10 anniversary following the completion of his sentence.

Martinez was prosecuted by Assistant District Attorney Adam Poole in the 405th District Court, with Judge Michelle Slaughter presiding. The investigation was conducted by the League City Police Department.
